TUPE

Employees have certain employment rights when their employer changes as a result of a business sale, corporate reorganisation, acquisition, merger, amalgamation or change in service provider.

Generally, these rights ensure that employees are not disadvantaged when they move employer. It is a complex area and our lawyers will help you avoid employment and commercial disputes, as well as minimising the financial impact of the change.

The relevant rights and obligations are set out in the TUPE Regulations, which were amended in 2014. TUPE is an acronym for the Transfer of Undertakings (Protection of Employment) Regulations.

The Government has published a helpful online guide to the 2006 Regulations, incorporating changes made in 2014. It can be found here
