Boys and Maughan LLP

We are pleased to inform our clients that Boys & Maughan converted from a partnership to a Limited Liability Partnership on 1 October 2020.

This will have very little effect on you as one of our clients and we are posting this article to our website for your information. You do not need to do anything unless you have a question or wish to discuss how the conversion will affect your particular circumstances. Please read on if you would like further details.

Boys & Maughan Solicitors is now a trading name of Boys & Maughan LLP. From the conversion date, Boys & Maughan LLP took on all the obligations and liabilities of Boys & Maughan Solicitors. All our staff automatically transferred across and continue to work as usual to progress the matters on which the Partnership was instructed on. The LLP has assumed responsibility for these matters going forward.

To combat the risks of cyber fraud, we have not changed our bank details for any of our client and office accounts. If you receive any requests to send money to different accounts, please do not comply with the requests, as the requests will not have been made by Boys & Maughan Solicitors or Boys & Maughan LLP. Please instead telephone the lawyer who deals with your affairs to notify us of the position.

Our terms of business remain exactly as set out for you previously, save that the terms of business apply to the LLP in place of the Partnership after the conversion date.

Money held on your behalf on client account on the conversion date is now held by Boys and Maughan LLP on your behalf on client account. The conversion will not affect the terms on which any monies are held, or the timing of any transactions.

We are proceeding on the basis that your continuing instructions will be confirmation that you are content to instruct Boys and Maughan LLP to act for you on the same terms of business, and to hold any client monies on your behalf. This avoids the need to sign a new written agreement.

It has always been important to us to provide you with a high standard of work, and there will be no change to the services you receive from us, or the cost of those services. The same lawyers will be carrying out your work from the same office, with the same telephone numbers and email addresses, and they will all continue to work with your best interests in mind in accordance with the instructions you have given.

There is no significant change to the operation or management of Boys & Maughan and the only obvious change is to our registered name. Our letter heading, emails and invoices look much the same but now feature references to Boys and Maughan LLP. If you had bills outstanding at the date of the conversion, they have been automatically transferred to the LLP.

The conversion will affect the personal liability of our partners. The partners are personally liable for claims against the firm, but they will not be personally liable for claims against the LLP. The SRA, our regulator, requires all solicitors to have minimum professional insurance terms in place and we will continue to comply with and exceed this requirement.

There will be no change to the rights you enjoy by instructing a solicitors’ practice authorised under the Legal Services Act 2007 and there will be no change to any rights you have to complain to the Legal Ombudsman.

Please get in touch with your usual contact at the firm if you have any questions.
