Prenuptial Agreements

The law now takes into consideration well-prepared prenuptial agreements.

Prenuptial agreements or prenups as they are commonly known have become a familiar aspect of modern marriages. In civil partnerships they are known as ‘pre-civil partnership agreements’. A prenuptial agreement (or pcpa) sets out what should happen to a couple’s assets and income in the event that their marriage or civil partnership should break down, and can avoid a preventable and expensive dispute.

Long, drawn-out litigation can arise because on divorce, or dissolution of a Civil Partnership, the courts have a very wide judgment to redistribute the parties’ property and income regardless of their legal ownership.

A well-constructed prenuptial agreement drafted by one of our Family lawyers allows couples a degree of self-regulation in their financial affairs and can be viewed as a form of insurance against costly litigation.
