Council Neglect Leads to £2,500 Claim
It is the responsibility of those whose property is accessed by members of the public to protect them from reasonably foreseeable injuries. In the case of roads and pavements, the organisation responsible for maintaining them in a safe condition is normally the local authority.
Failure to maintain public spaces in a safe condition can lead to a claim for damages if a pedestrian is injured as a result.
In a recent case, a pensioner who was walking along a road in the Hall Green area of Birmingham was awarded £2,500 in compensation from Birmingham City Council after she tripped and fell as a result of a pothole in the road.
The fall caused injuries to her shoulder and knee, producing significant symptoms that persisted for several weeks and meant that she had to have help carrying out everyday tasks.
